California Mandates for Harassment and Bullying Prevention

As an employer in California, you know how important harassment prevention training is.  The average payout -- even to settle -- runs about $150,000. And recent cases from Activision, the FDIC, and countless entertainers, politicians, and sports figures indicate that harassment ruins reputations and careers.  

Worse than that, harassment and bullying affects employee morale, quality, productivity, and commitment.  I've consulted for many clients to remedy a complaint, counsel employees, retrain, and review policies and investigation procedures. These cases are impossible to defend without documentation, training records, and investigation reports. 

Here's a summary of California requirements -- are you in compliance?  

  1. Provide the Sexual Harassment Fact Sheet from the California Civil Rights Department (formerly known as DFEH).

  2. Post the CCRD Anti-Discirmination Poster and EEOC poster in every "work location" (each floor and office, and provide for remote workers).

  3. Have a solid policy regarding discrimination and harassment.

  4. Publish a complaint handling procedure.

  5. Develop and follow strong investigation procedures in every matter that arises.

  6. Conduct biennial training for staff of one hour, we suggest you do this in onboarding to include discussion of harassment, retaliation, and complaint handling. Furthermore, content must include gender rights, bullying (abusive conduct), the impact of harassment, and other specific content.

  7. Supervisors, managers, and team leaders must be trained for 2 hours and they must be trained within 6 months of hire or promotion.

  8. Maintain all the records for a two-year period.

  9. If you operate in other states, you'll need to be aware of many other provisions.  We present eight state-specific versions plus a national and international version for multi-state and global employers.
